hi everyone. im not an epic club member (im one of the bree lads) nor is this a biking related question but seeing as this is one of the only sites i really bother to look at i thought i might as well ask here. i had some hassle in the last couple of years with having diesel oil/heating oil stolen. its become a seroius problem in the area. i had 1000 euro worth of oil stolen in april and i thought enough is enough. i bought a german shepard thats trained as a gaurd dog. problem solved no more intruders. the thing is even though he is a real pet to me/the wife/my parents everyone else seems to be fair game. the postman/coal man cant come near the place. i have all the signs up around the yard (warning gaurd dog) but im starting to wonder where would i stand if someone broke in and he actually bit them. i notified my insurance company and they were pretty vague about the sitiuation. maybe someone on here might have some info or experience on this matter. again sorry for the non biking related question. mick.

A solicitor would probably tell you where you stand. I assume it would be similar to knocking someone down in a car... the car will nearly always be blamed.
My sisters shepard was off the lead one day (he was very friendly) and he jumped up on a woman to say hello, as in on his hind legs with his paws on her stomach. She wasn't impressed, and got £5000 in an out of court settlement. that must be 10 years ago.

I think if you have the correct signs up then i think your ok, the person has entered at there own risk. The dog is there for a reason.
It's the same kinda thing with parking your car, if there is a sign saying 'parking at owners risk' and your car happens to get broken into it's your own fault, you were warned.

You can use reasonable force under the law for trespass. I would consider the dog as reasonable.
My brother checked out the legal position on this a couple of years ago after his shed was broken into 5 or 6 times;
According to his solicitor, as long as you have signs up advising on the prescence of a guard dog and that anyone entering the yard/garden/building in question is doing so at their own risk, you are covered.
Something to bear in mind though, you should be able to see the signs clearly and it might be a good idea if they were in a location that is lit at night.
You should be well covered if this is the case.
